About new approaches to the rehabilitation of debtors in the RK

Abstract

The article considers the problems of the effectiveness of rehabilitation procedures of the institute of insolvency in the national economy.In practice business entities do not consider the procedures of insolvency as mechanisms of recovery. The problem of professionalism in anticrisis management will be solved if the organizational and law conditions of practice will include tools to stimulate effective operation of experts in insolvency. The experience of Great Britain shows that the profession of manager of insolvency is one of the most prestigious and well-paid.
It is also noticed about the necessity of an effective system of regulation of the activities of managers in insolvency proceedings. It should be aimed at the formation of the optimal form of cooperation between the government and the selfregulating organization of professional managers in the field of rehabilitation and bankruptcy. This will ensure the independence of managers from various participants, increase their responsibility for the results of the rehabilitation and bankruptcy procedures.
Many business entities are interested in the liquidation of debtor and division of his properties during the insolvency proceedings. The quantity of rehabilitation procedures will be increased if the rights of bona fide debtors to retain their business with the help of the institution of insolvency are protected. However, the business controled under inept and dishonest owners should not be remained. An anti-crisis restructuring is suggested as effective mechanism of recovering of crisis management.
